Litigation & Dispute Resolution is a key area of legal practice that helps individuals, businesses, or organizations resolve conflicts, often through legal proceedings or alternative methods. In the Malaysian context, these services are important for managing disputes that arise in areas like contracts, business transactions, family matters, property disputes, or employment issues.
Litigation
Litigation involves resolving disputes through formal court proceedings. This process is usually initiated when the parties involved cannot come to an agreement on their own. In Malaysia, litigation follows a structured process governed by the rules of civil or criminal procedure, depending on the nature of the case.
Alternative Dispute Resolution
In addition to traditional litigation, dispute resolution encompasses alternative processes that aim to resolve conflicts more efficiently and cost-effectively. Common dispute resolution methods in Malaysia include:
1) Mediation – Involves a neutral third party (mediator) who helps both sides reach a voluntary settlement. The mediator doesn't make a decision but facilitates discussion to find a mutually acceptable solution.
2) Arbitration – A more formal alternative to litigation, where a neutral third party (arbitrator) hears both sides and makes a binding decision. Arbitration is often quicker and more private than court proceedings.
3) Adjudication – A process usually governed or mandated by specific statutes, such as the Construction Industry Payment and Adjudication Act 2012 (CIPAA) which mandates all disputing parties in a construction contract to refer their disputes first to Adjudication. Adjudication provides for quick relief of temporary finality to ease cashflow issues faced by the litigants.
