John Lee Kien How @ Mohd Johan Lee JC (Kuala Lumpur High Court)
The case involves a dispute within a long established association in Malaysia, where the plaintiff, a committee member, challenged the actions of the president and secretary regarding amendments to the Association's constitution. After the rejection of a proposed amendment to the Association’s constitution during the 2019 Annual General Meeting (AGM), the plaintiff later sought an injunction to prevent the 2021 AGM, citing procedural and constitutional irregularities. The Kuala Lumpur High Court initially granted the ex-parte injunction, but the defendants applied to have it set aside, arguing non-compliance with legal requirements and alleging the plaintiff’s failure to disclose all relevant facts. The court ultimately found the plaintiff had not met the legal standards for such an injunction and set aside the interim order, emphasizing that injunctive relief must be carefully granted particularly in association matters.
Marcus (together with Mr Lim Tien Loong) represented the defendants.
